Welcome to the Three Dog Bakery® Rewards Program (the “Program”). No purchase is necessary to become a member. These Terms and Conditions (“Terms”) describe how to register, the Program benefits, and the rules that apply to Three Dog Bakery (“us” or “we” or “TDB”) and to all of our Program members (“Member(s)” or “you” or “your”).

 

Please read these Terms carefully, as they apply to all Program Members. You must be 18 years or older to be a Member. These Terms will be visible when you enroll as a Member, and will also be accessible through the TDB website link at: www.threedogstores.com/rewards. These Terms are also subject to and are a part of our Terms of Use at https://threedogstores.com/terms-of-use/. We may revise and update these Terms from time to time in our sole discretion. All changes are effective immediately when we post them to the TDB website.

 

PROGRAM OVERVIEW

Our Program is designed to reward you – our loyal customers – for your purchases by fostering community, encouraging trial, and helping pet parents like you take the best possible care of their pups. Upon successful enrollment, and subject to these Terms, Members will be eligible to receive all the benefits associated with the Program.

 

You are always welcome to shop at any Three Dog Bakery stores without joining as a Program Member. You do not have to purchase anything to enroll as a Member. The Program is limited to qualifying products and services at Three Dog Bakery stores or on the TDB website.

 

ENROLLMENT AND PRIVACY

Enrollment in the Program is easy. Next time you visit one of our Three Dog Bakery locations, simply complete a customer profile by providing the following information to the TDB store team member: Your name, phone number, email, pet’s name, and pet’s birthday. We will enter all of that information for you, and you will be asked to confirm your enrollment and approve these Terms. Once your enrollment is complete, you will receive an email confirmation that your new “Member Account” has been activated. Following the multi-factor authentication instructions, you will have the ability to set your password and customize your Member Account information and Member Dashboard. (See “Member Dashboard” section below.)

 

The information we gather from you is Personal Data that you provide voluntarily. Personal Data is subject to our Privacy Policy at https://threedog.com/privacy-policy/. Please read the terms of our Privacy Policy to understand how we use and disclose your Personal Data. Please note that by accepting these Terms you are also accepting the terms of the Privacy Policy.

 

You may opt-out of the Program at any time and cancel your Member Account by following the instructions on your Member Dashboard. You may also opt-out of providing Personal Data or have your Personal Data removed from our databases by following the instructions in the Privacy Policy.

 

COMMUNICATIONS

We will use your Personal Data to send communications to you about the Program, which may include by way of example, information about your Program Points, offers, other Program benefits, and information pertaining to your Member Account. You hereby consent to receiving communications about the Program and your Member Account from us. Communications may by sent by email and/or text messages. If you receive communications by text message, you consent to the terms of our SMS Policy available at: _______________________

 

MEMBER ACCOUNT ADMINISTRATION AND ACCESS RIGHTS

You may update your Member Account information through your Member Dashboard or by contacting TDB Customer Service at contactus@threedogstores.com. Members are responsible for maintaining accurate and updated Personal Data used for your Member Account.

 

TDB Customer Service has the ability to correct Program Points errors and make Program Point claim adjustments. We may also require access to your Member Account in order to improve the Member experience, to confirm identification to address potential with fraud, and to resolve issues with the Program. In these cases, you will be asked to provide TDB Customer Service with you name, email, phone number, and/or Member ID. The decision to provide Personal Data is yours alone and voluntary.

 

We collect certain user experience information as described in our Privacy Policy. You hereby grant to TDB the right to monitor your Member Account activity. TDB reserves the right to take any necessary legal action based on fraud, abuse, or suspicious activity in connection with your Member Account. If you are engaged in such activity, you may be liable for monetary losses, including litigation and/or arbitration costs and damages. This section shall survive the termination of your Member Account.

 

PROGRAM BENEFITS

PROGRAM POINTS AND REWARDS

Members receive a variety of benefits including special promotional pricing and offers, “Program Point(s)” (described below) that may be used for in-store and online purchases, product rewards, and a coupon to celebrate your pet’s birthday or adoption day.

 

PROMOTIONAL PRICING

Members may take advantage of an everyday offer of Buy 3, Get 1 FREE on Three Dog Bakery packaged products in addition to surprise and delight special offers throughout the year. The free item will always be the item of the least value.

 

BIRTHDAY/ADOPTION DAY COUPON

Members who have created a pet profile and provided all required information will receive a single-use coupon to celebrate their pet’s birthday or adoption day. Only one date can be assigned per pet. The coupon is sent to Members via email. The coupon is valid for 30 days from customer issuance as set thereon. Limit 1 coupon per pet per year. Maximum 5 coupons per Member per year.

 

PROGRAM CHANGES

We reserve the right to shorten, extend, terminate, cancel, modify, or restrict any aspect or benefit of the Program, including, without limitation, these Terms, qualifying products, the Program Point conversion ratio, and the Program Point expiration policy at any time. TDB may make changes to the Program even if such changes affect your ability to use Program Points already accumulated. Changes can be made without advance notice. TDB reserves the right to discontinue the Program at any time.

 

HOW TO EARN PROGRAM POINTS

In addition to Bonus Points, as described below, Members may earn Program Points, that are Transactional Points or Engagement Points, as described below:

 

Transactional Points – earned by purchasing any merchandise from any TDB store.

Engagement Points – earned by completing an activity such as filling out your customer profile as part of your enrollment process.

 

Program Points will appear in your Member Account within a few days after completing the applicable purchase or activity. You may track your Program Points through your Member Account and customize your Member Dashboard views, as described in the “Member Dashboard” section below.

 

TRANSACTIONAL POINT REWARDS

Members earn 1 Transactional Point for every qualifying dollar spent before taxes. Once $200 is spent, a $5 reward will be added to your Member Account within a few days of purchase. Transactional Points earned are calculated at the product level and rounded to the nearest whole number. Transactional Point rewards do not expire except in the case of Member Account inactivity, as described in the “Program Point Expiration” section below. Rewards may be redeemed at your option and discretion and may be stacked with other $5 rewards.

 

HOW TO EARN TRANSACTIONAL POINTS

Purchases of eligible products and services made via the Website or in TDB stores are eligible for earning Transactional Program Points (“Transactional Points”). Transactional Points are only earned on amounts paid by a Member, excluding taxes, shipping, handling, discounts, or prices before discounts, coupons, gift cards, or other offers are applied.

 

To earn Transactional Points, you must provide the requested Member Account information at the time of purchase  as follows:

 

In-store: At the point of sale (POS) you must let the TDB store team member know that you are a Program Member. The TDB store team member will then input your phone number or email address into the POS and confirm your Program Member Account. Successful identification of your Program Member Account allows you to earn Transactional Points or apply coupons redeemed through the Program.

 

Online: A Member identifies themselves as a Member upon successful login to their Program account on the TDB website. A successful login is done using the Member’s email and corresponding password.

 

If you do not identify your Program Member Account status during purchase, or if Transactional Points were not awarded after you identified your Member Account due to any technical issues or errors, you will have up to 30 days from the date the purchase is completed to notify us, and have the applicable Transactional Points retroactively applied to your Member Account. To retroactively claim Transactional Points, Members must: (i) provide proof of purchase in the form of a transaction receipt; and (ii) Contact TDB Customer Service to provide the proof of purchase. TDB Customer Service will verify proof of purchase and manually credit Transactional Points to your Member Account. You may need to provide TDB Customer Service with your name, email, phone number, and/or Member ID, as requested, in order for TDB Customer Service to access your Member Account. You agree to provide this Personal Data in accordance with the Privacy Policy and as a condition of your Program membership. You Member Account will reflect the additional Transactional Points within a few days of TDB Customer Service verification. You may not retroactively claim Transactional Points if you were not enrolled as a Member at the time of purchase.

 

HOW TO EARN ENGAGEMENT POINTS

Members may earn Engagement Program Points (“Engagement Points”) by completing specified activities such as completing their profile. Activities are subject to frequency (number of times a Member may complete the activity to earn Engagement Points for it) and/or time (a date or date range within which the activity must be completed). Once a frequency or time constraint is reached as set forth on each engagement activity prompt, you will no longer be able to earn additional Engagement Points, but you may continue to participate in the activity (if the specific activity permits). Activity completion or participation may be restricted to specific channels. Activities are worth a fixed number of Engagement Points and point levels may vary. You must be logged into your Member Account or identify your Program membership in-store to earn Engagement Points.

 

BONUS POINT OPPORTUNITIES

From time to time, we will offer you the opportunity to earn additional points (“Bonus Points”) through purchasing certain products and/or completing certain activities. Bonus Point offers will be communicated to you based on your preferred communication preferences (e.g., email, SMS). Bonus Points may be earned as either point multipliers (e.g., 2x or 3x) or as flat point values (e.g., 50 Bonus Points).

 

Bonus Points may be earned both online and in-store, as specified in the offer. Bonus Points may be subject to additional terms and conditions as set forth on the applicable Bonus Point offer.

 

You must identify your Program membership status at the time of purchase or when completing the engagement activity in order to earn Bonus Points. Bonus Points may not be claimed retroactively and will not be available if the membership status has not been identified at the time or purchase or activity.

 

PROGRAM POINT TRACKING

You will be able to track your total Program Points at any given time by accessing your Member Dashboard where the most updated Program Point value will be displayed. You may also request your total Program Point value by contacting TDB Customer Service or requesting that information when visiting your local TDB store. Program Points will be removed from a Member Account for any returned purchase. (See “Program Point Adjustment – Returns & Exchanges” section below.)

 

PROGRAM POINT EXPIRATION

Program Points do not expire unless there have been no purchases credited to your Member Account for the prior 6 months, in which event, your Member Account will be deemed inactive, and all unused Program Points earned, regardless of how they were earned (e.g., Transactional Points, Engagement Points, and Bonus Points) will expire.

 

PROGRAM POINT MAXIMUM

There is no maximum number of total Program Points that you may hold in your Member Account at any given time; however, we reserve the right to apply a Program Point limit at any time and will provide notice to any Members impacted by this adjustment.

 

PROGRAM POINT ADJUSTMENT – RETURNS & EXCHANGES

Your Program Point balance will be adjusted based on any returns or exchanges as follows:

 

Returns

  • If you return a product(s) purchased with a coupon, the returned value will only equate to the total cash or credit originally paid (excluding taxes, shipping, handling, discounts, or prices before discounts, coupons, gift cards, or other offers are applied). Any discounts, coupons, gift cards, or other offers applied during the original transactions will not be credited back to you.
  • Product returns will result in a Program Point reconciliation whereby any Program Points earned on the original purchase are deducted from your total Program Point balance.
  • If a Program Point balance is less than the number of Program Points previously awarded for the purchased product, your Member Account may reflect a negative Program Point balance.

 

Exchanges

  • Product exchanges will result in a Program Point reconciliation whereby any Program Points earned on the original purchase are added to or deducted from your total Program Point balance.
  • Exchanges follow TDB’s exchange policies.
  • Program Point adjustments will be reflected in your Member Account within a few days of such exchange.

 

REWARD REDEMPTION

Program Points may be redeemed by logging onto your Member Account and following the instructions displayed on your Member Dashboard. Once you have logged in and are viewing your Member Dashboard, simply follow the prompts to redeem Program Points, and then apply them as a coupon towards product purchases. TDB reserves the right to limit the number of coupons that may be applied to a single transaction.

 

You may only apply accrued Program Points. You may not apply Program Points if that action will result in a negative balance. Pending (non-accrued) Program Points are those not yet reflected in your Program Point balance and are ineligible for redemption. Coupons earned through point redemption do not expire. Coupons earned through point redemption are valid in-store and online. Use of coupons is subject in all cases to these Terms and the terms and conditions displayed on the coupon.

 

COUPON REDEMPTION FOR PRODUCTS OR SERVICES

Coupons earned through Program Point redemption may be applied online or in-store.

 

You have full discretion to choose when and how to redeem your Program Points as coupons. Program Points must be converted to a coupon (as described above) in order to apply the Program Points to an online or in-store purchase. Coupons are not automatically applied. For online purchases, you must enter the alphanumeric code online at checkout.

 

Coupons must be applied in their entirety. Any leftover amount on coupon is forfeited (e.g., a $5 coupon applied to a $4.32 product forfeits the remaining $0.68).

 

REWARD NOTIFICATIONS

Members will be notified online via the Member Dashboard when there are sufficient Program Points in there Member Account for a reward redemption. Subject to your communication preferences, you may also receive notice of reward redemption availability by email or SMS.

 

In-Store Redemptions

A TDB store team member may notify you at POS that your Member Account has rewards available for redemption. Alternatively, you may ask to redeem your rewards at POS. Rewards valued at $5.00 do not require use of a coupon.

 

Online Redemptions

You must input the available alphanumeric code at checkout page. If a transaction is cancelled before being completed, Program Points will not be applied and the coupon will remain active.

 

Special Redemptions

The FREE Great Big Bone cookie and the birthday gift require a coupon that will be sent to you via email or push notification.

 

MEMBER DASHBOARD

Once your Member Account has been activated, you will be given access to the “Member Dashboard” which is accessible by logging into “My Rewards” via “My Account” at threedog.com/rewards. The Member Dashboard is a comprehensive hub for everything related to the Program. You can use the Member Dashboard to track your Program Points (total Program Points, types of Program Points, and Program Points earned through individual transactions), view rewards and offers, earn Engagement Points, exercise redemptions, and for any other Member-specific or Program-related information. Only Members and TDB administrators have access to the Member Dashboard. The Member Dashboard is personalized to each Member.

 

You will be able to customize your Member Dashboard to your own preferences and convenience, however, certain information displays may be subject to availability or other factors as determined by TDB. You may view, but will not have the option to edit, the following:

  • Information pertaining to automatic Program Point tallying, including total Program Points, Transactional Points, and Engagement Points
  • Available benefits or rewards
  • Purchase history
  • Engagement history

You understand that participation and engagement with digital tools are voluntary unless otherwise specified by TDB, and may be necessary to enable Program functionality (e.g., filling out required fields in a profile).

 

PET PROFILES

Members may create a pet profile for their pet(s). There is no restriction to the number of pets that may be connected with a single Member Account. Follow the on-screen instructions to complete all required fields and to create a pet profile.

 

MISCELLANEOUS

 

DISCLAIMERS

Three Dog Bakery is not responsible for incorrect or inaccurate transcription of information, for problems related to any of the equipment or programming associated with the Program or utilized by you, for any human error, for any interruption, downtime, deletion, omission, defect, or line failure of any telephone network or electronic transmission, for problems relating to computer equipment, software, inability to access the Website or online service, or for any other technical or non-technical error or malfunction.

 

TDB is not responsible for any change of email address, mailing address and/or telephone number of any Member or for any Program Points that are not received as a result of Member’s failure to provide accurate or up to date information. TDB is not responsible for any incorrect or inaccurate information supplied by you while participating in the Program. If a reward, or any portion thereof, cannot be provided for any reason, TDB reserves the right to substitute such reward with another of equal or greater value.

 

THE PROGRAM IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT REPRESENTATIONS OR WARRANTIES OF ANY KIND. TO THE FULLEST EXTENT ALLOWABLE BY LAW, THE RELEASEES SPECIFICALLY DISCLAIM ANY REPRESENTATIONS OR WARRANTIES, EXPRESS OR IMPLIED, REGARDING ANY PRODUCTS AND/OR SERVICES OFFERED BY ANY THIRD PARTY, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE AND IMPLIED WARRANTIES ARISING FROM COURSE OF DEALING OR COURSE OF PERFORMANCE. Some jurisdictions do not allow limitations on how long an implied warranty lasts, so the above limitation may not apply to you. You agree to rely solely on the manufacturer’s warranties, if any, for any products redeemed through this Program.

 

LIMITATION OF LIABILITY AND RELEASE

TO THE EXTENT PERMISSIBLE UNDER APPLICABLE LAW, THREE DOG BAKERY AND ITS RELATED COMPANIES, PARENTS, SUBSIDIARIES, AFFILIATES, AND AGENTS AND THEIR AGENCIES, SUPPLIERS AND OTHER COMPANIES INVOLVED IN THE DEVELOPMENT OR EXECUTION OF THE PROGRAM (“RELEASEES“) SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF THE PROGRAM OR MERCHANDISE OR ITEMS OFFERED THROUGH THE PROGRAM, EVEN IF ANY OR ALL OF THE FOREGOING OR ANY OF THEIR AUTHORIZED REPRESENTATIVES HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IF THREE DOG BAKERY IMPROPERLY DENIES YOU ANY REWARDS OR POINTS, OUR LIABILITY AND YOUR DIRECT DAMAGES WILL BE LIMITED TO THE EQUIVALENT AMOUNT OF REWARDS OR POINTS, AS APPLICABLE. BY PARTICIPATING IN THE PROGRAM, YOU WAIVE ANY AND ALL RIGHTS TO BRING ANY CLAIM OR ACTION RELATED TO SUCH MATTERS IN ANY FORUM BEYOND ONE (1) YEAR AFTER THE FIRST OCCURRENCE OF THE KIND OF ACT, EVENT, CONDITION, OR OMISSION UPON WHICH THE CLAIM OR ACTION IS BASED.

 

GOVERNING LAW AND ARBITRATION 

As a condition of participating in this Program, You agree that

 

All matters relating to these Terms and any dispute or claim arising therefrom or related thereto (in each case, including non-contractual disputes or claims), shall be governed by and construed in accordance with the laws of the State of Missouri without giving effect to any choice or conflict of law provision or rule (whether of the State of Missouri or of any other jurisdiction). Any legal suit, action or proceeding arising out of or relating to these Terms shall be instituted exclusively in the State or Federal courts of the United States located in Jackson County, Missouri. We retain the right to bring any suit, action or proceeding against you for breach of these Terms in your county of residence or in any other relevant county. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.

 

Any and all disputes, claims, and causes of action arising out of or connected with this Program, or any rewards obtained through the Program, shall be resolved individually, without resort to any form of class action and exclusively by arbitration under the International Arbitration Rules of the American Arbitration Association, applying Missouri law (without giving effect to any choice or conflict of law provision or rule, whether of the State of Missouri or of any other jurisdiction). Arbitration will take place in Kansas City, Missouri, U.S.A. Any and all claims, judgments and rewards shall be limited to actual out-of-pocket costs incurred, including costs associated with participating in this Program, but in no event attorneys’ fees. Under no circumstances will you be permitted to seek recovery for, and you hereby waive all rights to claim, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and waive any and all rights to have damages multiplied or otherwise increased.

 

ENFORCEABILITY; NO WAIVER OF RIGHTS

Nothing in these Terms shall be deemed to exclude or restrict any of your statutory rights as a consumer. If any provision in these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, such provision shall be severed from the remainder of these Terms which will otherwise remain in full force and effect. No waiver of any of the provisions in these Terms shall be deemed or shall constitute a waiver of any other provisions hereof (whether or not similar), nor shall waiver constitute a continuing waiver unless otherwise expressly provided.

 

TAXES

You are solely responsible for any federal, state, and local taxes associated with any purchases where applicable.

 

ASSIGNMENT

Program Member Accounts and Program Points are non-assignable, non-saleable, non-transferrable (including upon death, as part of domestic relations matters, or otherwise by operation of law), non-replaceable, do not constitute property of any Member and may not be redeemable for cash or have any cash value.
